Illinois Sexual Harassment Training Law
On August 9, 2019, Illinois Governor J.B. Pritzker signed Senate Bill 75, the Workplace Transparency Act, which amends the Illinois Human Rights Act. The Act requires that all employers in Illinois provide sexual harassment training to all employees, each year, starting in 2020. In addition to requiring annual sexual harassment training, the law makes other major changes to Illinois harassment and discrimination laws.
In addition to the Workplace Transparency Act, in 2018 Illinois passed Public Act 100-0762, which requires licensed professionals with continuing education requirements to complete at least one hour of sexual harassment prevention training annually, starting in 2020.

Illinois Training Law FAQ
Every employer with one or more employees working in the State of Illinois must provide employees with sexual harassment training.
All employees must receive training, including short-term employees, part-time employees, and interns.
The IDHR encourages employers to train new employees as soon as reasonably possible after hire. We recommend facilitating sexual harassment training as a part of your employee onboarding/orientation program to help reduce risk and liability immediately.
The first training deadline is December 31, 2020. After the deadline, training is required annually for every Illinois worker and supervisor.
Sexual Harassment training for Illinois employees is required to be provided at least annually.
While the new law does not mandate that employers provide training to independent contractors, the IDHR (Illinois Department of Human Rights) strongly recommends that contractors receive training.
Because employers are responsible for ensuring that the training received is compliant with the IHRA, it’s recommended that employers train all new employees, even if the employee received training at a previous employer.
However, if the employee can provide evidence that training has been received, and that training meets the legislative requirements, retraining does not need to be provided until the retraining interval.
Employers must keep records of all training, and upon request, these records must be made available for inspection by the IDHR. Training records may be a certificate of completion, a signed employee acknowledgment, or a course sign-in sheet. Both paper and electronic records are permissible.
